A. When Contract for Purchase or Lease of Subject Property Terminates. If a contract for purchase or lease of the subject property is indisputably terminated or expired, the property owner must notify the Department and the Department shall cease processing the application. If a contract for purchase or lease of the subject property that is the subject of the land use permit application has expired or terminated, the Department shall deem the owner's consent withdrawn for the purposes of the pending application and any proposal for modification of the application.

B. When Department Must Place Pending Application on Hold. In the event that an applicant is not the owner of the subject property and was under contract with the owner of the subject property at the time of the application but the legal status of such contract becomes disputed, the applicant must promptly notify the Department that the contract's legal status is in dispute. In the event that the applicant and owner of the subject property have a dispute with regard to whether applicant's lease or contract for purchase of the subject property has terminated, the Department shall place on hold any pending application for land use permits for development of the subject property pending the outcome of the resolution of such dispute. In no event shall the Department continue to process any pending land use permit applications for the subject property or allow any modifications to said applications or agree to any extensions of deadlines related to the applications after the owner of the subject property has notified the Department that the owner has withdrawn consent to such land use permit applications. Notice to the Department of the commencement of litigation between owner of the subject property and applicant with regard to the contract for purchase of the subject property shall be deemed notice that there is a legal dispute between the applicant and owner over the legal status of the contract for purchase. The Department must provide notice and opportunity to the owner of the subject property to respond to any requests for extensions, modifications, or other proposals communicated by the applicant to the Department.
