A. Potential Customer Information Meeting. A Potential Customer Information meeting shall be required for any Program Agreement that incorporates any of the financial or regulatory incentives provided for within this Chapter. The purpose of this Potential Customer Information Meeting is to make those where broadband service will become newly available aware of the impending provision of such services and to seek comment from potential customers.

B. Broadband Development Incentives Program Agreement. An application for a proposed project that incorporates any of the incentives in this Chapter shall not be approved until the applicant has submitted a signed Broadband Development Incentives Program Agreement stipulated in PCC 12.35.030.B as a component of the application package.

C. Required Implementation. After the final approval of a new project that incorporates any incentives provided for within this Chapter, the project must be completed as soon as feasible, and no later than two years after approval, unless otherwise stated in the Program Agreement, and service provided for a 10-year period subject to the granting of any required Franchise extension or renewal as provided in PCC 12.35.030.A. If service is no longer made available at any point within the 10-year period following service activation because the service provider fails to do so or because the Franchise or Program Agreement is terminated by the County in accordance with the terms and provisions of the Franchise or Program Agreement, the service provider must pay back a pro-rated portion of the financial incentives obtained for the period of time that service does not remain activated over the 10-year period.
