A. The sale of adult magazines as a secondary and incidental use within convenience stores and other similar retail uses shall be permitted subject to the following provisions:

1. The adult magazine sales area shall be limited to a single magazine/book rack with dimensions no larger than four feet by five feet. The rack shall be located behind the sales counter or in a locked display case.

2. All adult magazines shall be stored in the rack and no portion of the adult magazine that depicts "specified sexual activities" or "specified anatomical areas" shall be visible when the magazine is in the rack.

3. All other sales, rental, or display of books, periodicals, films, photographs, motion pictures, slides, video cassettes, other visual representations, and electronic media that are characterized by emphasis on the depiction, description, simulation, or relation to "specified sexual activities" or "specified anatomical areas"; or instruments, devices, or paraphernalia which are designed for use in connection with "specified sexual activities" are prohibited except that the sale of condoms and other birth control and disease prevention devices are allowed.

4. Convenience stores and other similar retail uses that conform to the above provisions shall not be considered an Adult Business.
