Each Telecommunications franchise granted hereunder for the use of County right-of-way is subject to the County's right, which is expressly reserved, to annually fix by ordinance a fair and reasonable compensation for use of the right-of-way pursuant to a franchise in an amount that reflects the County's actual and reasonable costs and other compensation permitted by law. To the extent that the Franchisee will provide broadband service to underserved or unserved areas that are located in Broadband Development Districts, the County may consider reducing the amount of franchise fee compensation attributable to such areas.
